1. Acceptance of Terms

Welcome to Overland Drams, LLC (“we”, “us”, “our”). By accessing or using our website, www.overlanddrams.com (the “Site”), and participating in any of our programs or services (“Programs”), you agree to be bound by these Terms and Conditions, as well as our Privacy Policy, and any additional guidelines or rules posted on the Site.  If you do not agree, you must not use our services.

2. Program Enrollment & Eligibility

  •  Participants must be 21 years or older to enroll in alcohol-related experience offered by Overland Drams (the “Programs”).
  •  The Program may include live sessions, recorded content, and interactive materials, accessible for a limited duration.

3. Payment, Refund & Cancellations

  •  Payments for the Experience, events, and memberships are final, except where explicitly stated in the Overland Drams Participant Agreement.

4. Text Messaging

If you choose to provide your mobile phone number and opt in, Overland Drams may contact you by text message. These messages may include event information, experience updates, reminders, and occasional details about our programs and offerings.

Text messaging is optional and not required to participate in any Overland Drams experience or to make a purchase. Message frequency varies, and standard message and data rates may apply.

You may opt out of receiving text messages at any time by replying STOP to any message. Once you opt out, you will no longer receive SMS messages from us, except as needed to confirm your request or as required by law.

5. Intellectual Property & Copyright Protection

  •  All program materials, branding, and digital content are the exclusive property of Overland Drams.
  •  Participants may not copy, share, or distribute any content without prior written permission.
  •  Unauthorized use of Overland Drams’ branding, materials, or recordings may result in legal action.

6. Participant Conduct & Community Standards

  •  Participants agree to maintain a positive and respectful presence in all Overland Drams Programs.
  •  Disruptive or inappropriate behavior will result in removal from the Program(s) without refund.

7. Limitation of Liability

To the fullest extent permitted by law, Overland Drams disclaims any warranties or liability for:

  •  Alcohol consumption and personal risks associated with participation.
  •  Third-party services, vendors, or suppliers involved in alcohol sample kits.
  •  Website downtime, payment failures, or digital content accessibility issues. 

8. Payment and Fees 

By purchasing access to any of our Programs, you agree to pay the applicable fees as stated on the Site. These fees are non-refundable unless otherwise stated. Payment must be made in full before access to Programs is granted. We reserve the right to modify pricing, fees, or payment structures at any time, but such changes will not affect programs for which you have already registered. 

9. User Content

By submitting content, including but not limited to reviews, testimonials, comments, photos, or videos, to our Site or in connection with any Program, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, modify, display, and distribute such content for promotional and commercial purposes. You represent and warrant that you have the necessary rights to submit such content and that it does not infringe any third-party rights. 

10. Program Participation

While we strive to offer high-quality experiences, we do not guarantee any specific outcomes or results from participating in our Programs. The content shared in our programs, including testimonials, should not be interpreted as a guarantee of similar results. You agree to participate in Programs voluntarily and at your own risk. 

11. Modification to Terms

We reserve the right to modify, update, or change these Terms and Conditions at any time. Any changes will be posted on this page, and the updated Terms will be effective immediately upon posting. It is your responsibility to review these Terms periodically. Continued use of the Site following any changes signifies your acceptance of the updated Terms.

12. Termination

We reserve the right to terminate or suspend your access to the Site and Programs at our sole discretion, without notice, for any reason, including but not limited to violation of these Terms and Conditions or any behavior that disrupts the operation of the Site or Programs.

13. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the State of Colorado. Any disputes shall be resolved through binding arbitration in Colorado.
